How to Sell a Home Through Probate in Los Angeles or Orange County

From court appointments to closing, here's every step of the probate sale process and how long each one typically takes in LA and Orange County.

If you're in a position where you need to sell a home through probate in Los Angeles or Orange County, you've probably already figured out that this isn't like a typical home sale. There's a legal process involved, extra paperwork, and timelines that don't always move as quickly as you'd like. And underneath all of that, there's usually something personal going on too. 

So let me walk you through the basic steps and, more importantly, how long this usually takes, so you know what you're stepping into.

Getting appointed by the court. Before anything can happen, someone has to be officially appointed to handle the estate. That means going through probate court to become the executor or the administrator. In LA and Orange County, this step alone usually takes four to eight weeks, sometimes longer if the courts are backed up. Until that appointment happens, you can't legally sell the property. This is where everything starts.

Full authority vs. limited authority. At the same time, you'll find out whether you have full authority or limited authority. This doesn't add any extra time upfront, but it changes what happens later. Full authority gives you more control over the sale. Limited authority means the court will need to approve the sale before it's final. Think of it as the difference between a smoother path and one with an extra checkpoint near the end.

Preparing the property. Once you're appointed, things become more hands-on. You'll need to secure the property, handle insurance, and start clearing things out. This part varies a lot. Some homes take a few days, others take weeks, and some take months. On average, one to three weeks is pretty typical in this area.

The probate appraisal. In a probate sale, the court assigns a probate referee to determine the home's value. That usually takes about two to four weeks in LA and Orange County. Here's the detail most people don't realize: the accepted offer generally has to be at least 90% of the appraised value. So pricing isn't just about what the market says. It's tied directly to that court-ordered appraisal.

Going live on the market. Once you have the appraisal, you can list the home. From there, most probate homes in this area take about 2 to 4 weeks to get into escrow, assuming the pricing and condition make sense for buyers. Even in probate, well-positioned homes still move.

Where the path splits. This is where full authority and limited authority really make a difference. If you have full authority, you can accept an offer and proceed as with a normal sale. If you have limited authority, the sale goes to court for confirmation, which usually adds another four to eight weeks. Sometimes there's an overbid hearing where other buyers can show up and bid higher. It doesn't always happen, but it is part of the process here in California.

Closing. Once everything is approved, closing usually takes another two to three weeks. That part finally starts to feel familiar again.

The full timeline. When you put it all together, most probate sales in Los Angeles and Orange County take anywhere from three to six months if you have full authority, and four to eight months if court confirmation is required. Sometimes quicker, sometimes a little longer, but that's the range I see over and over again.
